To whom does it apply?

The Unruh Civil Rights Act originally targeted brick-and-mortar businesses, but now applies to digital ones as well. Under the Act, all businesses are required to provide equal accommodations, advantages, facilities, privileges, or services. These include, but are not limited to:

Unlike the ADA Title III, which only applies to websites that have a physical location, the Unruh Act expressly applies to all businesses, including those that are digital-only.

In addition, the Unruh Civil Rights Act allows plaintiffs in disabilities access lawsuits to claim monetary damages. Plaintiffs can claim up to three times the amount of damages, plus attorneys’ fees for each access violation.
